Moovila Inc. (“Moovila,” “we,” or “us”) provides cloud-based software services to companies and other organizations by providing enterprise accounts accessible at www.moovila.com (the “Site”) and through the Moovila web-based mobile application (collectively with the Site referred to herein as the “App”). This Privacy Statement describes how we collect, use, and otherwise process personal information about registered end users of the App (“you” or “End Users”) on behalf of the employer or other organization which as procured and provisioned your access to the App (“Organization”), your rights with regard to your information and the measures we take to protect it. By registering your account or using the App, you accept and consent to the terms of this Privacy Statement in effect at the time of your use.
When you use the App, you are also subject to the policies of your organization. We are not responsible for the privacy or security practices of your Organization, which may differ from those set forth in this Privacy Statement.
A. TYPES OF INFORMATION WE COLLECT AND HOW WE COLLECT IT
Personal information is information that directly or indirectly identifies or can be used to identify you as an individual. The types of information we collect and the manner and means by which it is processed are all determined by your Organization and pursuant to the contractual arrangement between your Organization and Moovila. You can choose not to provide your personal information to us. However, some information about you is required to register your account. As an End User, you may also be required to provide certain information based on policies imposed by your Organization, which may be provided to you separately.
The following are categories of personal information we may collect about you and how we collect it, the specifics of which are controlled and determined by your Organization:
Information from Your Organization. In order to establish or authorize your account, your Organization provides us with information such as your name, job title, and e-mail address. Your Organization may also provide us with information about projects, jobs, and other tasks assigned to you.
Information You Provide to Us. We collect information that you provide when you use the App. For example, we collect your user/display name and hashed password when you register your account with us or information you provide if you choose to further customize your profile, such as by uploading a profile picture.
Note that the App does not allow and is not intended to collect or process sensitive or special categories of personal information such as health / medical or financial information, race or ethnic origin, political opinions, religious or philosophical beliefs or similar.
Information Collected Automatically. Certain information is also collected automatically through the App, depending on your Organization’s specifications and your choices. For example:
Device and Browser Information. When you access the App, we may automatically collect information about your device and your use of the App, such as IP address, browser type, log files, or device ID. We may also track the activities you complete within the App and other usage data such as the date and time you access the App.
Mobile Device and Other Location Data. If you choose to allow location tracking from your device, the App will collect your geolocation while you are within the perimeter of your assigned job site or location specified by your Organization. Upon leaving that defined perimeter, the App will stop tracking your location. If you upload photos to the App, we collect the image you provide and information associated with the image, including when the image was taken, which End User uploaded it and the location where the photo was taken. You can manage how your mobile device shares location data or prevent the App from collecting your geolocation by adjusting the controls and disabling location services on your mobile device or within the App.
B. HOW WE USE YOUR INFORMATION
Your access to the App is provided by your Organization and Moovila processes your personal information pursuant to a contract between your Organization and Moovila. Moovila is a data processor of End User personal information and we use such information to provide the Services to your Organization and you and for our legitimate business purposes. Your Organization is the data controller of End User personal information and controls the manner and means by which we process such information in conjunction with the Services, as set forth in the contractual arrangement between your Organization and Moovila. Use of End User data is subject to your Organization’s privacy policies. C. WHEN WE SHARE YOUR INFORMATION
We share End User personal information as directed by your Organization, in accordance with the contractual arrangement between your Organization and Moovila or with your consent. When you use the App, your Organization will have access to your personal information, including time clock information, usage and diagnostic data, and general access to the other information described above in Section A of this Privacy Statement.

D. YOUR RIGHTS AND CHOICES
You may have certain rights and choices with regard to your personal information. You should direct any privacy questions, including any requests to exercise your data protection rights, to your Organization’s administrator.
E. INTERNATIONAL DATA TRANSFERS
Our business and our Services are located and operated in the United States and we will process your personal information in the United States and any other jurisdictions where we, our servers or our service providers are located. If you are located outside the United States, we may transfer your personal information to the United States where necessary for our performance of a contract with you or Your Organization and as necessary to provide the Services to you or your Organization. The laws and protections for personal information in the United States may vary from those in the jurisdiction where you are located and may not provide the same level of data protection. When we transfer data from outside the United States, we implement appropriate and suitable safeguards intended to protect your information and in accordance with this Privacy Statement.
F. HOW WE SECURE YOUR INFORMATION
We implement physical, administrative and technical security measures to help safeguard personal information from loss and unauthorized access, use, disclosure or transfer. Notwithstanding our safeguards, we cannot guarantee the security of any information transmitted over the Internet or through the App. We suggest you also take steps to help protect your information by protecting the confidentiality of your user credentials, using complex passwords to secure your account, and maintaining up-to-date operating systems and software on your device.
G. DATA RETENTION
We keep your personal information for as long as it is needed to fulfill the purposes for which it was collected and in accordance with the contract between your Organization and Moovila. The precise period will depend on the reason why it was collected and the terms of the contract.
We do not knowingly collect information from persons under the age of 18. To use the App, you must be the age of legal majority in your place of residence and at least 18 years old. We will use commercially reasonable efforts to delete information associated with a minor as soon as practicable if we learn that a minor has submitted information to us through the App.
I. CHANGES TO THIS PRIVACY STATEMENT
We reserve the right to make changes or updates to this Privacy Statement from time to time, effective from the date indicated as the last updated date of the Privacy Statement. Please check the Services periodically to review such changes which will be posted to the App. Your continued use of the App means you accept those changes as of the last updated date.
